§1. GENERAL INFORMATION

SkayTek Software is a software manufacturer and sells its software in am online shop registered at ul. Barczewskiego 31, 11-001 Dywity, Poland. The company registered its business activity under the number 2122, where the registrar was the Commune Administrator in Dywity. NIP (Tax Id. No.): PL7392009197, Business reg. no.: 510608623. Product - software, also referred to as "Digital Content", provided as a downloadable file that is not stored on a media.
Customer - purchaser.
Account - a collection of data stored in the SkayTek Software ICT system uniquely identifying the Client.
Consumer - a natural person who undertakes with an entrepreneur a legal activity not directly related to his/her business or profession within the meaning of Article 221 of the Civil Code.
Remote contract - an agreement concluded with the consumer within the framework of a structured remote contracting system, without the physical presence of the parties, with an exclusive use of one or more means of distance communication till the moment of concluding the contract.
 

§2. ORDER FULFILLMENT

2.1. Method and date of payment.

The order system provides two payment methods: PayPal and Bank Transfer.

PayPal payment - The user is redirected to the PayPal page and creates a payment that is not yet approved. Continuing the order process, PayPal redirects the user back to the shop's website where the user sees the order. In this step the buyer confirms the order or cancels the transaction. The shop system approves the transaction and sends a confirmation to the email address given in the order.
Bank transfer payment - after placing an order, the shop system sends a confirmation to the email address given in the order with the details about the bank account number that the money transfer needs to be made to. In the case of the above payment method, the shop system expects the payment to be made within 2 weeks. If the money is not transfered within 2 weeks the order is automatically canceled.
 
2.2. Method and time of order fulfillment.
Method of order fulfillment - the product is delivered as a digital file to download. The file should be downloaded with License Manager which is available in the Download section at https://skaytek.com/.
Order fulfillment time - with PayPal payment, the transaction is authorized immediately and access to the product is granted immediately after the order is made. However, with Bank Transfer the product can be downloaded immediately when the shop system charges a fee.
 

§3. GUARANTEE AND PROCEDURE FOR COMPLAINTS

3.1. SkayTek Software grants the owner of the purchased product a guarantee for a period of 30 days from the date of purchase, which only covers the delivery of the purchased product. The guarrantee does not apply to software. The warranty does not exclude, limit or suspend the buyer's rights stemming form the provisions on liability for defective items.
3.2. In order to exercise the guarantee rights, the owner of the purchased product shall report in writing the defect to the seller from whom he purchased it at complaint@skaytek.com describing the problem type, giving his phone number and order number.
3.3. No later than 7 days after filing a product complaint, a SkayTek Software representative shall contact you by phone or e-mail to discuss the details of the problem and find ways to resolve it.
3.4. The supplier will deal with the complaint and will notify the purchaser of its settlement immediately, not later than within 14 days after receiving the complaint, to the e-mail address indicated by the purchaser when creating the account.
 

§4. OBLIGATION TO PROVIDE PRODUCTS WITHOUT DEFECTS

4.1. It is the the seller's reposnisbility if the product sold to the purchase has some physical or legal defect in accordance with the provisions of the Civil Code Art. 556.
 

§5. FUNCTIONALITY, INTEROPERABILITY OF DIGITAL CONTENT WITH HARDWARE AND SOFTWARE AND TECHNICAL PROTECTIVE MEASURES

5.1. For most product use, you are required to have a Microsoft Windows-based software product specifically Visual Studio with .NET 4.5 support. The functionality of the provided digital content is described in the product card. SkayTek Software software is protected against unauthorized use with a usage certificate that the purchaser generates independently using the provided License Manager software.
 

§6. A RIGHT TO WITHDRAW FROM A CONTRACT

6.1. According to the Consumer Rights Act (Journal of Laws of 2014, pos. 827), the Consumer has the right to withdraw from the contract within 14 days after its conclusion.
6.2. The consumer is not entitled to withdraw from the contract if the subject matter is an audio or visual product or computer programs delivered in sealed packaging and if the packaging has been opened after delivery.
6.3. If the Customer consents to receive digital content that is not recorded on any media before the expiration of the withdrawal period and if the Consumer is informed by SkayTek Software of the loss of the right of withdrawal, the withdrawal right expires the moment the the order is placed in accordance with art. 38 sec. 13 of the Consumer Rights Act of 30 May 2014 (Journal of Laws of 2005, pos. 827). The above agreement loses its legal basis if the buyer is an Entrepreneur.
 

§7. FINAL PROVISIONS

7.1. In matters not covered by these Regulations, the provisions of the Consumer Rights Act, the Civil Code, the Copyright and Related Rights Act shall apply.
7.2. The law applicable to the agreement between the User and SkayTek Software is Polish law. Any disputes related to the implementation of the agreement will be resolved by the relevant Polish common courts.
7.3. The customer being a consumer has the following opportunities for using out-of-court ways to have complaints processed and pursue claims.
The customer is entitled to apply to the Court of Conciliation at the Trade Inspection to request settlement of the dispute arising from the concluded Sales Agreement.
The customer is entitled to apply to the provincial inspector of the Trade Inspection for the initiation of mediation proceedings on the amicable settlement of the dispute between the Customer and the Seller.
